Our approach to privacy

We collect and use personal information only where we have a legitimate reason to do so. We aim to be clear about what we collect, why we need it, how long we keep it, when we share it, and the choices available to you.

This Privacy Notice explains how Flat98 Talent handles personal information when you use our website, join the Flat98 Talent Community, participate in a Career Diagnostic, communicate with us, or engage with us as an employer, partner, or other professional contact.

1. Who we are

Flat98 Talent is operated by Flat98 Strategies and Communications, LLC. Flat98 Talent is a registered trade name of Flat98 Strategies and Communications, LLC in the Netherlands.

For purposes of applicable data-protection law, Flat98 Strategies and Communications, LLC is the controller of the personal information described in this Privacy Notice.

2. Information we collect

Depending on how you interact with Flat98 Talent, we may collect identification and contact information; professional information; Talent Community profile information; Career Diagnostic responses; CVs, résumés, and other professional materials you provide; employer or partner information; account and authentication information; and limited website and analytics information where you have consented to optional analytics.

Professional information may include employment history, role, experience level, education, skills, languages, LinkedIn profile, professional interests, work authorization, sponsorship requirements, preferred locations, and work arrangements.

Career Diagnostic information may also include information about your accomplishments, job search, professional goals, practical constraints, and other information you choose to provide.

3. Why we use your information

We use personal information to operate the Talent Community, identify potentially relevant professional opportunities, provide Career Diagnostics, respond to inquiries, manage employer and partner relationships, operate accounts and authentication, protect our systems, and meet applicable business and legal obligations.

Depending on the activity, our legal basis may be your consent, steps taken at your request or performance of a service, compliance with a legal obligation, or our legitimate interests where those interests do not override your rights and interests.

4. Flat98 Talent Community

Joining the Flat98 Talent Community allows us to maintain a professional profile and use that information to identify opportunities that may align with your experience and interests.

Joining the Talent Community does not enroll you in a paid membership or general marketing communications.

Flat98 Talent will not provide your profile or CV to an employer simply because you joined the Talent Community. Where we identify a potential opportunity, our approach is to contact you about that opportunity before sharing your professional materials or making an employer introduction.

You may leave the Talent Community and withdraw your consent at any time. Withdrawal does not affect processing that was lawful before withdrawal.

5. Career Diagnostic

The Flat98 Talent Career Diagnostic is a separate service designed to help professionals understand how their experience may translate into the market, where potential pathways may exist, and what practical next steps may strengthen their professional positioning.

Information provided for a Career Diagnostic is used to prepare and deliver the Diagnostic and associated guidance. Career Diagnostic information is not published by Flat98 Talent or shared with employers merely because you participated in the service.

Participation in a Career Diagnostic does not automatically enroll you in the Talent Community.

6. Employers and partners

When an employer, prospective employer, partner, or other organization interacts with Flat98 Talent, we may process professional contact information and information necessary to understand and administer that relationship.

Where candidate information is shared as part of an agreed introduction, that information should be used only for the purpose for which it was provided and handled consistently with applicable law and the Flat98 Talent Employer Terms.

7. Analytics and cookies

Flat98 Talent uses optional analytics to understand how visitors use the website and improve the experience. Optional analytics storage is denied unless you consent through our analytics controls.

You can accept or decline optional analytics through the website consent controls.

8. When we share information

We do not sell personal information.

We may share personal information with service providers that help operate Flat98 Talent; with employers where a candidate introduction has been discussed and authorized; where necessary to provide a requested service; with professional advisers where reasonably necessary; where required by law or legal process; or where necessary to establish, exercise, or defend legal rights.

9. International transfers

Some technology providers used by Flat98 Talent may process personal information outside the European Economic Area. Where European data-protection law applies, we use an appropriate transfer mechanism or safeguard where required.

10. How long we keep information

We keep personal information only as long as reasonably necessary for the purpose for which it was collected.

• Active Talent Community profiles are retained while the person remains actively participating.
• We may request profile confirmation approximately every 12 months, and inactive or unconfirmed profiles are normally deleted or anonymized after 24 months without confirmation.
• Following withdrawal from the Talent Community, use for matching stops immediately and substantive profile information and an associated CV are normally deleted or anonymized within 30 days.
• Minimal consent and withdrawal records may be retained for up to five years where reasonably necessary to document consent and compliance.
• Career Diagnostic submissions are normally retained for up to 12 months after delivery of the completed Diagnostic.
• A CV provided only for a Career Diagnostic is normally deleted within 90 days after delivery of the completed Diagnostic.
• Employer and partner inquiries are normally retained for up to 24 months after the last meaningful interaction unless a continuing relationship exists.

These periods are maximum operating periods, not minimums. Where you have a valid right to deletion, we will assess and act on that request in accordance with applicable law.

11. Your privacy rights

Depending on applicable law, you may have rights to access, correct, delete, restrict, or object to certain processing of your personal information and to receive certain information in a portable format.

Where processing is based on consent, you may withdraw that consent at any time. You may also lodge a complaint with the relevant supervisory authority. In the Netherlands, this is the Autoriteit Persoonsgegevens.

12. Security

We use technical and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. No system can guarantee absolute security.

13. Technology-assisted review and human judgment

Flat98 Talent may use technology to assist with organizing information, researching opportunities, identifying possible relevance, and supporting internal review.

Technology-assisted results do not replace the human judgment at the center of the Flat98 Talent model. Flat98 Talent does not currently make decisions based solely on automated processing that produce legal effects, or similarly significant effects, concerning candidates.

14. Children

Flat98 Talent's professional services are intended for adults and are not directed to children. We do not knowingly seek to collect personal information from children through the Talent Community or Career Diagnostic.

15. Changes to this Privacy Notice

We may update this Privacy Notice as Flat98 Talent develops or as our legal, technical, or operational practices change. When we make material changes, we will update the date at the top of this notice and provide additional notice where appropriate.
